Barcelona are preparing to lodge an appeal to the Court of Arbitration for Sport in Lausanne to determine whether they are able to register Arda Turan, should they fail to gain authorization to do so by FIFA later this week.
Club sources have told Spanish news agency EFE that Barcelona will present an appeal to FIFA’s Appeal Committee, asking for confirmation that the club has now completed the FIFA-imposed transfer ban which left them unable to register players during the past two inscription periods. Such confirmation, Barça believe, will allow them to register Arda Turan as a replacement for Rafinha Alcántara who is set to miss the rest of the season with a serious knee ligament injury.
Barça claim that FIFA have only responded “in a simply informative manner” to state that the RFEF is not able to register Arda as it would run the risk of “entering into conflict” with FIFA, “who regulate such situations”.
The club is aware that their case, which could be resolved within 10 days by FIFA’s Appeal Committee, is likely to be thrown out. Under such a scenario, they have made provisions to take their appeal to the Court of Arbitration for Sport.
In Laussane, Barça will seek provisional registration of Arda with the LFP as well as confirmation that the club has complied with and completed the FIFA ban during the past two transfer windows which would enable them to register the Turkish midfielder and also the 37 minors who are waiting to be listed with their football academy.
RFEF regulations state that clubs can register players from their youth team at any point in the season, so if the Court of Arbitration rule that Barça have completed the ban, the club will be within their rights to immediately register all of their under-age youth players. Barça will also ask the Court of Arbitration to recognize that the under-age players who, according to FIFA cannot be regularized under international law, will now be able to train and live on-site at La Masía.
If Barça are given the go ahead to provisionally register Arda, they hope that the player will be able to make his official debut by the end of November or the start of December and not have to wait until 4 January as FIFA have ordered them to do.
Barça are aware that the Court of Arbitration for Sport can take between six and eight months to reach a verdict, but their principal objective is to get official confirmation that they are in the right on the matter.
